Seller-paid costs can help a buyer manage cash needed at closing, but the proposed credit must fit the actual mortgage program and eligible expenses. Fannie Mae’s interested-party contribution rules distinguish financing concessions from sales concessions. Its rules do not allow these contributions to replace the borrower’s down payment or required reserves.
Before writing the offer, ask the lender to estimate the eligible closing costs and the applicable contribution limit. For Fannie Mae loans, limits depend on factors including occupancy and loan-to-value, and a credit above eligible costs can require different treatment. Do not assume the same percentage works for every borrower or program.
For discussion, create two versions of the proposed deal: one emphasizing a lower price and one emphasizing an eligible cost credit. Ask Paul to compare cash needed, payment and any qualification effects using the same assumptions. There is no universal winner; the buyer’s cash position and plans matter.
Put negotiated terms into the appropriate transaction documents and provide them to the lender. Ask your Realtor or attorney how to word and amend the contract. Do not rely on an undisclosed side agreement. For an agent, identifying an unusable credit before the contract is signed can prevent confusion later in the transaction.
